1. Introduction

These Terms & Conditions (“Terms”) govern the use of the Launchly platform (“Service”), operated by Launchly, Mon Bras Droit, Operator, official Register number : 934848433. Based in France. (“Provider”, “we”, “our”, “us”).

By accessing or using the Service, you (“User”, “you”, “your”) agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

Launchly provides an AI-powered platform that generates business ideas, mini business plans, and execution roadmaps based on answers provided in an interactive questionnaire.

The Service is intended for informational and educational purposes only. We do not guarantee the accuracy, completeness, originality, or success of any generated idea or plan.

3. Eligibility

  • You must be at least 18 years old to use the Service.

  • By using Launchly, you confirm that you have the legal capacity to enter into these Terms.

4. Accounts

  • You must provide accurate information when creating an account (including name and email).

  • You are responsible for maintaining the confidentiality of your login credentials.

  • We may suspend or terminate accounts that violate these Terms.

5. Pricing & Payments

  • Pay-Per-Project Model: Launchly operates on a one-time purchase model. Users purchase project packs (e.g., 2 projects for $9, 10 projects for $29).

  • No Subscriptions: There are no recurring charges, renewals, or monthly commitments. Each purchase is independent.

  • Payments: All payments are processed securely via Stripe.

  • Refunds: No refunds are provided once a project has been generated, as digital content is delivered instantly.

  • Usage: Purchased projects may be used at any time. Unused project credits do not expire unless otherwise stated.

6. Intellectual Property & Generated Content

  1. Ownership of Outputs

    All business ideas, plans, and other content generated through Launchly (the “Generated Content”) belong fully and exclusively to the User. Users are free to use, exploit, and commercialize the Generated Content without restriction.

  2. No Guarantee of Originality

    While the Generated Content is produced through artificial intelligence technology (OpenAI and related providers), Launchly makes no representation or warranty that the Generated Content is unique, novel, or free from similarities to existing works, businesses, or ideas.

  3. User Responsibility

    The User is solely responsible for verifying the feasibility, originality, legality, and compliance of the Generated Content before any use, execution, or commercialization. Launchly disclaims any liability for potential overlaps, infringements, or commercial failures resulting from the use of the Generated Content.

  4. No Professional Advice

    The Generated Content is provided strictly for informational and educational purposes only and shall not be considered professional, financial, legal, or business advice. Users should seek independent professional advice before making business or financial decisions.

7. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes.

  • Attempt to copy, reverse-engineer, or resell the Service.

  • Misuse the platform in ways that may harm its functionality or other Users.

8. Limitation of Liability

  • The Service is provided “as is” without warranties of any kind.

  • Launchly does not guarantee business success, profitability, or specific outcomes.

  • To the maximum extent permitted by law, Launchly and its operator shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to financial losses, lost profits, loss of data, or business opportunities arising from the use of the Service.

9. Service Availability

We strive to maintain continuous Service availability but do not guarantee uninterrupted or error-free access.

We may suspend, modify, or discontinue the Service at any time without liability.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or misuse the Service.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France.

Any dispute shall fall under the exclusive jurisdiction of the courts of Mulhouse, France.

12. Data & Privacy

  • We collect personal data (name, email, questionnaire responses) for the purpose of providing the Service.

  • Data is securely stored in Supabase.

  • A separate Private Policy describes in detail how we process personal data in compliance with the GDPR.

13. Changes to the Terms

We may update these Terms at any time. Updates will be effective immediately upon posting on our website. Continued use of the Service constitutes acceptance of the revised Terms.
